General Terms & Conditions
1) GENERAL PROVISIONS
These Terms and Conditions apply to purchases in the online store operated by OQEMA, s.r.o. effective from November 1, 2025. These conditions define and specify the rights and obligations of the Seller, which is OQEMA, s.r.o., with its registered office at Šenov, Těšínská 222, Postcode 73934, ID (IČ): 63988186, registered in the Commercial Register in Section C, Insert 38395 at the Regional Court in Ostrava, and the Buyer (customer, consumer).
All contractual relationships are concluded in accordance with the legal order of the Czech Republic. If the contracting party is a consumer, relationships not regulated by these terms and conditions are governed by the Civil Code (No. 89/2012 Coll.) and the Consumer Protection Act (No. 634/1992 Coll.). If the contracting party is not a consumer, relationships not regulated by these terms and conditions are governed by the Civil Code (No. 89/2012 Coll.).
By placing a binding order, the Buyer confirms that they accept the Terms and Conditions for the delivery of goods issued by the Seller. The relationship between the Buyer and the Seller is governed by these terms and conditions, which are binding for both parties.
By agreeing to these terms and conditions, the Buyer confirms that they have reached the age of 18, are legally competent, and have full legal responsibility. This fact shall be proven upon receipt of the ordered goods with a valid personal identity document.
Effective from November 1, 2025, purchases in the OQEMA, s.r.o. online store are permitted exclusively for customers with a valid ID Number (IČO). The Buyer is obliged to provide and document their IČO during registration or when ordering; otherwise, the order cannot be processed.
2) ORDERING GOODS AND SERVICES
The Seller offers the possibility of purchasing directly from your home, where the Buyer can shop 24/7. The subject of the contract is only the goods listed in the purchase agreement – the order. Dimensions, weight, performance, capacity, and other data listed on our website, in catalogs, brochures, and other printed materials are non-binding data based on information from manufacturers. In case of discrepancies, the Seller will contact the Buyer.
The condition for the validity of an electronic order is the completion of all required data and formalities specified in the order form. The order also constitutes a draft purchase agreement, whereby the purchase agreement itself is subsequently created by the delivery of the goods. Formal confirmation of the order by the Seller is required to conclude the purchase agreement.
In the event that a significant change in the foreign exchange rate or a change in the price or range supplied by the supplier occurs during the period the goods were ordered, the Seller has the right to modify the order in agreement with the Buyer or to withdraw from it unilaterally with immediate effect.
3) ORDER CONFIRMATION
The order is accepted within 24 hours. Order confirmation will be sent via e-mail or by telephone; the Buyer will be informed of the dispatch via e-mail. In case of uncertainty, the Seller will contact the Buyer.
4) ORDER CANCELLATION
The Buyer may cancel any order within 24 hours by telephone or e-mail without giving a reason. It is sufficient to provide the name, e-mail, and description of the ordered goods.
5) PACKAGING AND POSTAGE
The Seller sends the ordered goods to the Buyer via a transport company. The shipping price varies depending on the weight of the ordered goods and is listed on the "Shipping Price" page.

Packaging prices (excluding VAT):
Pallet 60x80 cm - 130 CZK
Pallet 60x120 cm - 250 CZK
Small crate - 200 CZK
Large crate - 250 CZK
6) DELIVERY TIME
The delivery time is between 3 and 10 days unless stated otherwise. In the case of personal collection, the goods are ready only after the information e-mail has been sent.
7) EXCHANGE OF GOODS
If necessary, the Seller will exchange unused and undamaged goods for another type within 14 days of receipt. Shipping costs associated with the exchange of goods are borne entirely by the Buyer.
8) RETURN OF GOODS
The possibility of returning goods is within 14 days of receipt. The shipping fee is not refunded upon return.
9) COMPLAINTS AND WARRANTY
Any complaints will be handled by the Seller in accordance with the valid legal order. The Buyer is obliged to inspect the goods after receipt to identify any obvious defects. The warranty does not cover defects caused by normal use, incorrect use, or incorrect storage.
Complaint procedure:
1. The Buyer informs about the complaint by e-mail or in writing.
2. The Buyer delivers the goods to one of the Seller's warehouses.
3. The Buyer states the reason for the complaint and their address.
4. The Buyer presents proof of acquisition of the goods (invoice).
10) RESTRICTIONS ON THE SALE OF CERTAIN SUBSTANCES
Regulation (EU) No. 2019/1148 of the European Parliament and of the Council on the marketing and use of explosives precursors restricts free access to certain substances for members of the general public:
1. The restriction applies to hydrogen peroxide from 12% and Persteril.
2. The sale of explosives precursors to individuals without an ID Number (IČO) is prohibited.
3. The sale is also prohibited to legal entities acting for purposes not related to their trade, business, or profession.
